Payments via personal checks and handdelivered cash are not possible.

Returns and Exchanges

My number one goal is for you to be completely satisfied with every purchase.
I strive to provide the best possible shopping experience for my customers.
If for any reason you are not 100% satisfied with your order, you may exchange or return most items for a full refund of the original price paid, less shipping, within 30 days of the invoice date, as long as it is unused.

Credits will be transferred to your Pay-Pal account.

Items returned to me MUST be in their original condition!
For your own protection, please send your return items in a rigid cardboard box or bubble-padded envelope.
I recommend, but do not require that you insure your package as I am not responsible for product returns that reach me damaged, and will not credit you for these items.
Items returned to me in a standard unpadded envelope are almost certain to be damaged by the postal service. For all returns please kindly ensure that sufficient postage is affixed to the package. I will not accept a delivery, I have to pay for.

I hope for your understanding that I DO NOT accept returns on custom made items or special orders.
All returns must include a copy of the original invoice.

Terms and Conditions with customer information

§ 1. Scope

1.1. For the business relationship between me Elisabeth Amon, Radnitzkygasse 47, 1100 Vienna (hereinafter referred to as “seller”) and the customer (hereinafter “customer”), the following terms and conditions apply exclusively in their version valid at the time of the order.
1.2. You can reach me via E-Mail at: Lisa @ vetromagic.at.
1.3 Quotations made by me may override parts of these terms and conditions (for example, terms of delivery and payment), but this has no effect on the validity of other points in these terms and conditions.
1.4. Should by change of the legal situation parts of these terms and conditions lose their validity, this has no effect on the validity of other points of these terms and conditions.
1.5. Deviating conditions of the customer are not recognized, unless I expressly agree to their validity in writing.

§ 2. Offers and service descriptions

2.1. The presentation of the products in the online shop does not constitute a legally binding offer, but an invitation to place an order. Service descriptions in catalogs as well as on the websites of the seller do not have the character of an assurance or guarantee.
2.2. All offers are valid “as long as stocks last”, unless otherwise noted in the products. Incidentally, errors remain reserved.

§ 3. Ordering process and conclusion of contract

3.1. The customer can select products from the assortment of the seller without obligation and collect them via the button [to the shopping cart] in a so-called shopping cart.
3.2 The customer can then proceed within the shopping cart via the [Continue to checkout] button to complete the ordering process.
3.3. With the button [Buy], the customer makes a binding offer to buy the goods in the shopping cart. Before sending the order, the customer can change and view the data at any time. Necessary information is marked with an asterisk (*).
3.4. The seller then sends the customer an automatic confirmation of receipt by e-mail, in which the customer’s order is listed again and which the customer can print out via the “Print” function (order confirmation). The automatic acknowledgment of receipt merely documents that the customer’s order has been received by the seller and does not constitute acceptance of the request. The purchase contract is only concluded when the seller ships the ordered product to the customer, transfers it or sends it to the customer within 2 days with a second e-mail, express order confirmation or sending the invoice has confirmed.
3.5. If the customer chooses bank transfer or payment via Paypal (prepayment), the contract comes about with the provision of bank details and payment request. If, despite the due date, the payment has not been received by the seller after renewed request until 10 calendar days after sending the order confirmation, the seller withdraws from the contract, with the result that the order is invalid and the seller does not fulfill the obligation to deliver. The order is then done for the buyer and seller without further consequences. A reservation of the article in advance payments is therefore for a maximum of 10 calendar days.

§ 4. Prices and shipping costs

4.1. All prices quoted on the seller’s website are VAT free.  They do not include sales tax (small business regulation
§ 6 Abs. 1 Z 27 UStG)
4.2. In addition to the prices quoted, the seller charges for delivery. The shipping costs are clearly communicated to the buyer on the shipping side and within the ordering process. Shipping does not include tax.
4.3. Deliveries to foreign countries may incur duties, taxes and fees which are not included in the total price displayed. The buyer takes note of this.

§ 5. Delivery, availability of goods

5.1. If no copies of the product selected by him are available at the time of the customer’s order, the seller shall inform the customer immediately by e-mail. If the product is permanently non-deliverable, the seller looks away from a declaration of acceptance. A contract is not concluded in this case.
5.2. If the product designated by the customer in the order is only temporarily unavailable, the seller will also inform the customer immediately by email. In the event of a delivery delay of more than two weeks, the customer has the right to withdraw from the contract. Incidentally, in this case, the seller is entitled to withdraw from the contract. In this case, the seller will immediately refund any payments already made by the customer. As far as advance payment has been agreed, delivery will take place after receipt of the invoice amount.

§ 6. Payment modalities

6.1. The customer can choose from the available payment methods within and before the order process.
6.2. If third-party providers are charged with payment processing, e.g. Paypal. their terms and conditions apply.
6.3. If the due date of the payment is determined according to the calendar, the customer is already in default by default of the appointment. In this case, the customer has to pay default interest of 5 percentage points above the base rate.
6.4. The obligation of the customer to pay default interest does not exclude the assertion of further damages by the seller.
6.5. The customer is only entitled to offset if his counterclaims have been legally established or recognized by the seller. The customer can only exercise a right of retention if the claims result from the same contractual relationship.

7. Retention of title

Until full payment, the delivered goods remain the property of the seller.

§ 8. Warranty and guarantee

8.1. The warranty is determined by legal regulations.
8.2. There is a guarantee on the goods delivered by the seller only if expressly stated.

§ 9. Liability

9.1. For a liability of the seller for damages, the following exclusions and limitations apply without prejudice to the other statutory eligibility requirements.
9.2. The seller is liable without limitation, as far as the cause of damage is based on intent or gross negligence.
9.3. Furthermore, the seller is liable for the slightly negligent breach of material obligations whose breach jeopardizes the achievement of the purpose of the contract, or for the breach of duties whose fulfillment enables the proper execution of the contract in the first place and whose compliance the customer regularly trusts. In this case, however, the seller is only liable for the foreseeable, contract-typical damage. The seller is not liable for slightly negligent breaches of obligations other than those specified in the preceding sentences.
9.4. The above limitations of liability shall not apply to injury to life, limb or health, to a defect after assuming a guarantee for the quality of the product and fraudulently concealed defects. Liability under the Product Liability Act remains unaffected.
9.5. As far as the liability of the seller is excluded or limited, this also applies to the personal liability of employees, representatives and vicarious agents.

§ 10. Right of withdrawal

10.1. Each customer can within 14 days after receipt of the goods by sending a written declaration of resignation without giving reasons to withdraw from the contract. It is sufficient if the resignation is sent within this period (it decides the date of the postal order). In this case, the customer is demonstrably obliged to return the goods without delay. The return shipping costs (postage) are to be borne by the customer. Cash on delivery is not accepted. If the goods were used and / or damaged, the customer has to pay a reasonable fee for the use, including a reasonable compensation for the damages incurred – at the maximum amount of the value of the goods – to the seller. The declaration of withdrawal must be sent to the following address:

10.4 Cancellation by simply returning the goods

The customer can also exercise his right of withdrawal by merely verifiably returning the goods to the seller within 14 days of receipt without written notice of resignation. For a preservation of the period is sufficient in this case, the verifiable timely dispatch of the goods. The prerequisite for this form of exercise of the right of withdrawal by simply returning the goods is that the goods are not damaged or used and the return is sufficiently postage paid. The seller bears the return shipping costs (postage) only in the case of a wrong or faulty delivery. Cash on delivery is not accepted.

The risk of the return as well as its proof lies with the customer. In the case of a resignation of the customer (by explicit declaration or simple return of the goods), the seller pays back immediately the already paid purchase price – shipping costs are not refunded.

§ 11. Information on the exclusion of the right of withdrawal

The right of withdrawal does not apply to delivery of goods that are made to customer specifications or clearly tailored to personal needs or when delivering audio or video recordings they e-documents such as tutorials and e-journals.

§ 12. Return

12.1. Customers are requested to return the item to the seller prior to return (Lisa@vetromagic.at) to announce the return. In this way, they enable the seller to assign the products as quickly as possible.
12.2. Customers are requested to return the goods as a prepaid package to the seller and to keep the shipping document. Upon request, the seller will reimburse the customer for the postage costs, unless they are to be borne by the buyer.
12.3. Customers are requested to avoid damage or contamination of the goods. If possible, the goods should be returned to the seller in their original packaging with all accessories. If the original packaging is no longer in the seller’s possession, other suitable packaging should be used to provide adequate protection against transport damage and to avoid any claims for damages due to defective packaging.
12.4. The modalities mentioned in this section (no. 12) of the terms and conditions are not a prerequisite for the effective exercise of the resignation acc. No. 10 of these Terms.

§ 13. Storage of the contract text

13.1. The seller stores the contract text of the order. The terms and conditions are available online. The customer can print the text of the contract before submitting the order to the seller by using the print function of his browser in the last step of the order.
13.2. The seller also sends the customer an order confirmation with all order data to the e-mail address provided by him. Furthermore, the customer receives a copy of the terms and conditions with his order.

§ 14. Privacy

14.1. The seller processes personal data of the customer earmarked and in accordance with the statutory provisions.
14.2. The personal data provided for the purpose of ordering goods (such as name, e-mail address, address, payment details) are used by the seller for the performance and execution of the contract. This information will be kept confidential and will not be shared with third parties who are not involved in the ordering, delivery and payment process.
14.3. The customer has the right, upon request, to receive free information about the personal data stored by the seller about him. In addition, he has the right to correct inaccurate data, blocking and deletion of his personal data, as far as no legal duty of retention precludes.
14.4. Further information on the nature, extent, location and purpose of the collection, processing and use of the required personal data by the seller can be found in the privacy policy.

§ 15. Liability

15.1. By ticking the terms and conditions, the buyer confirms that he has taken note of the detailed safety instructions (here: http://shop.vetromagic.at/sicherheit/). For a disobey the seller can not be held liable.

15.2. The seller is liable in addition to the o.g. Warranty claims only for other damages to the customer, as far as nothing else follows or claims for injury to life, limb or health, according to product liability law or tort.

15.3. Further claims of the customer, in particular due to lost profit or other pecuniary loss, for whatever legal reason, are excluded.

15.4. This does not apply if the damage is due to intentional or grossly negligent action or at least negligent violation of a material contractual obligation of the seller. Excluded are also damages due to malice and the assumption of a guarantee, which aims to protect the customer from such damage.

§ 16. Severability clause, applicable law

16.1. Should a provision of these general terms and conditions or a provision in the context of other agreement of this contract be ineffective, this does not affect the validity of the other agreements. Instead of the ineffective provision, an appropriate provision shall be made which, in terms of the legally permissible possibilities, comes closest to the ineffective clause in its economic effect.

16.2. If the buyer has no general jurisdiction within the European Union, our place of business is jurisdiction.

16.3. As far as legally permissible, Vienna is the place of jurisdiction for entrepreneurs, persons under public law or special funds under public law. The seller is entitled to bring action also at the customer’s place of business.

16.4. The place of performance for all obligations arising from the contractual relationship is the respective registered office of the seller.

§ 17. Place of jurisdiction, applicable law, contract language

17.1. Jurisdiction and place of performance is the seat of the seller, if the customer is a merchant, a legal entity under public law or a special fund under public law.
17.2. The law of the Republic of Austria applies. This does not apply if mandatory consumer protection laws preclude such an application.
17.3. Contract language is German.

§ 18. Online Dispute Resolution

Online dispute resolution pursuant to Art. 14 para. 1 ODR-VO: The European Commission provides a platform for online dispute resolution (OS), which can be found at http://ec.europa.eu/consumers/odr/.

Allgemeine Geschäftsbedingungen mit Kundeninformationen

§ 1. Geltungsbereich

1.1. Für die Geschäftsbeziehung zwischen mir Elisabeth Amon, Radnitzkygasse 47, 1100 Wien (nachfolgend „Verkäufer“) und dem Kunden (nachfolgend „Kunde“) gelten ausschließlich die nachfolgenden Allgemeinen Geschäftsbedingungen in ihrer zum Zeitpunkt der Bestellung gültigen Fassung.
1.2. Sie erreichen mich per E-Mail unter: Lisa @ vetromagic.at.
1.3 Von mir gestellte Angebote können Teile dieser AGB außer Kraft setzen (z.B. Liefer- und Zahlungsbedingungen), was jedoch keine Auswirkung auf die Gültigkeit anderer Punkte dieser AGB hat.
1.4. Sollten durch Veränderung der Gesetzeslage Teile dieser AGB ihre Gültigkeit verlieren, hat dies keine Auswirkung auf die Gültigkeit anderer Punkte dieser AGB.
1.5. Abweichende Bedingungen des Kunden werden nicht anerkannt, es sei denn, ich stimme ihrer Geltung ausdrücklich schriftlich zu.

§ 2. Angebote und Leistungsbeschreibungen

2.1. Die Darstellung der Produkte im Online-Shop stellt kein rechtlich bindendes Angebot, sondern eine Aufforderung zur Abgabe einer Bestellung dar. Leistungsbeschreibungen in Katalogen sowie auf den Websites des Verkäufers haben nicht den Charakter einer Zusicherung oder Garantie.
2.2. Alle Angebote gelten „solange der Vorrat reicht“, wenn nicht bei den Produkten etwas anderes vermerkt ist. Im Übrigen bleiben Irrtümer vorbehalten.

§ 3. Bestellvorgang und Vertragsabschluss

3.1. Der Kunde kann aus dem Sortiment des Verkäufers Produkte unverbindlich auswählen und diese über die Schaltfläche [in den Warenkorb] in einem so genannten Warenkorb sammeln.
3.2 Anschließend kann der Kunde innerhalb des Warenkorbs über die Schaltfläche [Weiter zur Kasse] zum Abschluss des Bestellvorgangs schreiten.
3.3. Über die Schaltfläche [Kaufen] gibt der Kunde einen verbindliches Angebot zum Kauf der im Warenkorb befindlichen Waren ab. Vor Abschicken der Bestellung kann der Kunde die Daten jederzeit ändern und einsehen. Notwendige Angaben sind mit einem Sternchen (*) gekennzeichnet.
3.4. Der Verkäufer schickt daraufhin dem Kunden eine automatische Empfangsbestätigung per E-Mail zu, in welcher die Bestellung des Kunden nochmals aufgeführt wird und die der Kunde über die Funktion „Drucken“ ausdrucken kann (Bestellbestätigung). Die automatische Empfangsbestätigung dokumentiert lediglich, dass die Bestellung des Kunden beim Verkäufer eingegangen ist und stellt keine Annahme des Antrags dar. Der Kaufvertrag kommt erst dann zustande, wenn der Verkäufer das bestellte Produkt an den Kunden versendet, übergibt oder den Versand an den Kunden innerhalb von 2 Tagen mit einer zweiten E-Mail, ausdrücklicher Auftragsbestätigung oder Zusendung der Rechnung bestätigt hat.
3.5. Wählt der Kunde Banküberweisung oder Zahlung via Paypal (Vorauskasse) kommt der Vertrag mit der Bereitstellung der Bankdaten und Zahlungsaufforderung zustande. Wenn die Zahlung trotz Fälligkeit auch nach erneuter Aufforderung nicht bis zu einem Zeitpunkt von 10 Kalendertagen nach Absendung der Bestellbestätigung beim Verkäufer eingegangen ist, tritt der Verkäufer vom Vertrag zurück mit der Folge, dass die Bestellung hinfällig ist und den Verkäufer keine Lieferpflicht trifft. Die Bestellung ist dann für den Käufer und Verkäufer ohne weitere Folgen erledigt. Eine Reservierung des Artikels bei Vorkassezahlungen erfolgt daher längstens für 10 Kalendertage.

§ 4. Preise und Versandkosten

4.1. Alle Preise, die auf der Website des Verkäufers angegeben sind, unterliegen der österreichischen Kleinunternehmerregelung gem. § 6 Abs. 1 Z 27 UStG. Sie enthalten KEINE Umsatzsteuer.

4.2. Zusätzlich zu den angegebenen Preisen berechnet der Verkäufer für die Lieferung Versandkosten. Die Versandkosten werden dem Käufer auf der Versandkostenseite und im Rahmen des Bestellvorgangs deutlich mitgeteilt und enthalten KEINE Umsatzsteuer.
4.3. Bei Lieferungen in das Ausland können Zölle, Steuern und Gebühren anfallen, die im angezeigten Gesamtpreis nicht enthalten sind. Der Käufer nimmt dies zur Kenntnis.

§ 5. Lieferung, Warenverfügbarkeit

5.1. Sind zum Zeitpunkt der Bestellung des Kunden keine Exemplare des von ihm ausgewählten Produkts verfügbar, so teilt der Verkäufer dem Kunden dies per Email umgehend mit. Ist das Produkt dauerhaft nicht lieferbar, sieht der Verkäufer von einer Annahmeerklärung ab. Ein Vertrag kommt in diesem Fall nicht zustande.
5.2. Ist das vom Kunden in der Bestellung bezeichnete Produkt nur vorübergehend nicht verfügbar, teilt der Verkäufer dem Kunden dies ebenfalls unverzüglich per Email mit. Bei einer Lieferungsverzögerung von mehr als zwei Wochen hat der Kunde das Recht, vom Vertrag zurückzutreten. Im Übrigen ist in diesem Fall auch der Verkäufer berechtigt, sich vom Vertrag zu lösen. Hierbei wird der Verkäufer eventuell bereits geleistete Zahlungen des Kunden unverzüglich erstatten. Soweit Vorkasse vereinbart ist, erfolgt die Lieferung nach Eingang des Rechnungsbetrages.

§ 6. Zahlungsmodalitäten

6.1. Der Kunde kann im Rahmen und vor Abschluss des Bestellvorgangs aus den zur Verfügung stehenden Zahlungsarten wählen.
6.2. Werden Drittanbieter mit der Zahlungsabwicklung beauftragt, z.B. Paypal. gelten deren Allgemeine Geschäftsbedingungen.
6.3. Ist die Fälligkeit der Zahlung nach dem Kalender bestimmt, so kommt der Kunde bereits durch Versäumung des Termins in Verzug. In diesem Fall hat der Kunde Verzugszinsen in Höhe von 5 Prozentpunkten über dem Basiszinssatz zu zahlen.
6.4. Die Verpflichtung des Kunden zur Zahlung von Verzugszinsen schließt die Geltendmachung weiterer Verzugsschäden durch den Verkäufer nicht aus.
6.5. Ein Recht zur Aufrechnung steht dem Kunden nur zu, wenn seine Gegenansprüche rechtskräftig festgestellt oder von dem Verkäufer anerkannt sind. Der Kunde kann ein Zurückbehaltungsrecht nur ausüben, soweit die Ansprüche aus dem gleichen Vertragsverhältnis resultieren.

7. Eigentumsvorbehalt

Bis zur vollständigen Bezahlung verbleiben die gelieferten Waren im Eigentum des Verkäufers.

§ 8. Sachmängelgewährleistung und Garantie

8.1. Die Gewährleistung bestimmt sich nach gesetzlichen Vorschriften.
8.2. Eine Garantie besteht bei den vom Verkäufer gelieferten Waren nur, wenn diese ausdrücklich angegeben wurde.

§ 9. Haftung

9.1. Für eine Haftung des Verkäufers auf Schadensersatz gelten unbeschadet der sonstigen gesetzlichen Anspruchsvoraussetzungen folgende Haftungsausschlüsse und -begrenzungen.
9.2. Der Verkäufer haftet unbeschränkt, soweit die Schadensursache auf Vorsatz oder grober Fahrlässigkeit beruht.
9.3. Ferner haftet der Verkäufer für die leicht fahrlässige Verletzung von wesentlichen Pflichten, deren Verletzung die Erreichung des Vertragszwecks gefährdet, oder für die Verletzung von Pflichten, deren Erfüllung die ordnungsgemäße Durchführung des Vertrages überhaupt erst ermöglicht und auf deren Einhaltung der Kunde regelmäßig vertraut. In diesem Fall haftet der Verkäufer jedoch nur für den vorhersehbaren, vertragstypischen Schaden. Der Verkäufer haftet nicht für die leicht fahrlässige Verletzung anderer als der in den vorstehenden Sätzen genannten Pflichten.
9.4. Die vorstehenden Haftungsbeschränkungen gelten nicht bei Verletzung von Leben, Körper und Gesundheit, für einen Mangel nach Übernahme einer Garantie für die Beschaffenheit des Produktes und bei arglistig verschwiegenen Mängeln. Die Haftung nach dem Produkthaftungsgesetz bleibt unberührt.
9.5. Soweit die Haftung des Verkäufers ausgeschlossen oder beschränkt ist, gilt dies auch für die persönliche Haftung von Arbeitnehmern, Vertretern und Erfüllungsgehilfen.

§ 10. Rücktrittsrecht

10.1. Jeder Kunde kann binnen 14 Tagen nach Erhalt der Ware durch Absenden einer schriftlichen Rücktrittserklärung ohne Angaben von Gründen vom geschlossenen Vertrag zurücktreten. Dafür genügt es, wenn die Rücktrittserklärung innerhalb dieser Frist abgesendet wird (es entscheidet das Datum des Postaufgabescheines). Der Kunde ist in diesem Fall zur unverzüglichen Rücksendung der Ware nachweislich verpflichtet. Die Rückversandkosten (Porto) sind vom Kunden zu tragen. Nachnahme wird nicht akzeptiert. Wurde die Ware benützt und/oder beschädigt hat der Kunde ein angemessenes Entgelt für die Benützung einschließlich einer angemessenen Entschädigung für die entstandenen Schäden – maximal in Höhe des Warenwertes – an den Verkäufer zu zahlen. Die Rücktrittserklärung ist an folgende Adresse zu senden:

10.4 Rücktritt durch schlichte Rücksendung der Ware

Der Kunde kann sein Rücktrittsrecht auch dadurch ausüben, dass er lediglich die Ware innerhalb von 14 Tagen nach Erhalt ohne schriftliche Rücktrittserklärung an den Verkäufer nachweislich zurückschickt. Für eine Wahrung der Frist genügt in diesem Fall die nachweislich rechtzeitige Absendung der Ware. Voraussetzung für diese Form der Ausübung des Rücktrittsrechtes durch schlichte Rücksendung der Ware ist, dass die Ware nicht beschädigt oder gebraucht ist sowie die Rücksendung ausreichend frankiert erfolgt. Ausschließlich bei einer falsch-oder mangelhaften Lieferung trägt der Verkäufer die Rückversandkosten (Porto). Nachnahme wird nicht akzeptiert.

Die Gefahr der Rücksendung sowie dessen Nachweis liegt jeweils beim Kunden. Im Falle eines Rücktrittes des Kunden (durch ausdrückliche Erklärung oder schlichte Rücksendung der Ware), zahlt der Verkäufer umgehend den bereits entrichteten Kaufpreis zurück – Versandkosten werden nicht rückerstattet.

§ 11. Hinweise zum Ausschluss des Rücktrittsrechts

Das Rücktrittsrecht besteht nicht bei Lieferung von Waren, die nach Kundenspezifikation angefertigt werden oder eindeutig auf die persönlichen Bedürfnisse zugeschnitten sind oder bei Lieferung von Audio- oder Videoaufzeichnungen sie e-Dokumenten wie zB Tutorials und e-Zeitschriften.

§ 12.  Rücksendung

12.1. Kunden werden vor Rücksendung gebeten die Rücksendung beim Verkäufer zu melden  (Lisa@vetromagic.at), um die Rücksendung anzukündigen. Auf diese Weise ermöglichen sie dem Verkäufer eine schnellstmögliche Zuordnung der Produkte.
12.2. Kunden werden gebeten die Ware als frankiertes Paket an den Verkäufer zurück zu senden und den Versandbeleg aufzubewahren. Der Verkäufer erstattet den Kunden auf Wunsch vorab die Portokosten, sofern diese nicht vom Käufer selbst zu tragen sind.
12.3. Kunden werden gebeten Beschädigungen oder Verunreinigungen der Ware zu vermeiden. Die Ware sollte nach Möglichkeit in Originalverpackung mit sämtlichem Zubehör an den Verkäufer zurück gesendet werden. Ist die Originalverpackung nicht mehr im Besitz des Verkäufers, sollte eine andere geeigneten Verpackung verwendet werden, um für einen ausreichenden Schutz vor Transportschäden zu sorgen und etwaige Schadensersatzansprüche wegen Beschädigungen infolge mangelhafter Verpackung zu vermeiden.
12.4. Die in diesem Abschnitt (Nr. 12) der AGB genannten Modalitäten sind nicht Voraussetzung für die wirksame Ausübung des Rücktritts gem. Nr. 10 dieser AGB.

§ 13. Speicherung des Vertragstextes

13.1. Der Verkäufer speichert den Vertragstext der Bestellung. Die AGB sind online abrufbar. Der Kunde kann den Vertragstext vor der Abgabe der Bestellung an den Verkäufer ausdrucken, indem er im letzten Schritt der Bestellung die Druckfunktion seines Browsers nutzt.
13.2. Der Verkäufer sendet dem Kunden außerdem eine Bestellbestätigung mit allen Bestelldaten an die von Ihm angegebene E-Mail-Adresse zu. Ferner erhält der Kunde eine Kopie der AGB mit seiner Bestellung.

§ 14. Datenschutz

14.1. Der Verkäufer verarbeitet personenbezogene Daten des Kunden zweckgebunden und gemäß den gesetzlichen Bestimmungen.
14.2. Die zum Zwecke der Bestellung von Waren angegebenen persönlichen Daten (wie zum Beispiel Name, E-Mail-Adresse, Anschrift, Zahlungsdaten) werden vom Verkäufer zur Erfüllung und Abwicklung des Vertrags verwendet. Diese Daten werden vertraulich behandelt und nicht an Dritte weitergegeben, die nicht am Bestell-, Auslieferungs- und Zahlungsvorgang beteiligt sind. Die Telefonnummer wird einzig für den Versand erfragt – und an dhl/Hermes weitergegeben, sollte es im Zustellungsprozess zu Fragen kommen.
14.3. Der Kunde hat das Recht, auf Antrag unentgeltlich Auskunft zu erhalten über die personenbezogenen Daten, die vom Verkäufer über ihn gespeichert wurden. Zusätzlich hat er das Recht auf Berichtigung unrichtiger Daten, Sperrung und Löschung seiner personenbezogenen Daten, soweit keine gesetzliche Aufbewahrungspflicht entgegensteht.
14.4. Weitere Informationen über Art, Umfang, Ort und Zweck der Erhebung, Verarbeitung und Nutzung der erforderlichen personenbezogenen Daten durch den Verkäufer finden sich in der Datenschutzerklärung.

§ 15. Haftung

15.1. Der Käufer bestätigt mit dem ankreuzen des AGB, die ausführlichen Sicherheitshinweise (hier: http://shop.vetromagic.at/sicherheit/) zur Kenntnis genommen zu haben. Für ein nicht befolgen kann vom Verkäufer keine Haftung übernommen werden.

15.2. Der Verkäufer haftet neben den o.g. Gewährleistungsansprüchen nur für sonstige Schäden beim Kunden, soweit sich nachfolgend nichts anderes ergibt oder bei Ansprüchen wegen Verletzung des Lebens, des Körpers oder der Gesundheit, nach Produkthaftungsgesetz oder aus Delikt.

15.3. Weitergehende Ansprüche des Kunden, insbesondere wegen entgangenem Gewinn oder sonstigen Vermögensschäden, gleich aus welchem Rechtsgrund, sind ausgeschlossen.

15.4. Das gilt nicht, wenn der Schaden auf ein vorsätzliches oder grob fahrlässiges Handeln oder die wenigstens fahrlässige Verletzung einer wesentlichen Vertragspflicht des Verkäufers zurückzuführen ist. Ausgenommen sind auch Schäden wegen Arglist und Übernahme einer Garantie, die gerade den Schutz des Kunden vor solchen Schäden bezweckt.

§ 16. Salvatorische Klausel, anwendbares Recht

16.1. Sollte eine Bestimmung dieser allgemeinen Geschäftsbedingungen oder eine Bestimmung im Rahmen sonstiger Vereinbarung dieses Vertrages unwirksam sein, berührt dies die Wirksamkeit der sonstigen Vereinbarungen nicht. Anstelle der unwirksamen Regelung soll eine angemessene Regelung treten, die im Rahmen der gesetzlich zulässigen Möglichkeiten der unwirksamen Klausel in ihrer wirtschaftlichen Wirkung am nächsten kommt.

16.2. Hat der Käufer keinen allgemeinen Gerichtstand innerhalb der Europäischen Union, ist unser Geschäftssitz Gerichtsstand.

16.3. Gegenüber Unternehmern, Personen des öffentlichen Rechts oder öffentlich-rechtlichen Sondervermögen wird – soweit gesetzlich zulässig – Wien als Gerichtsstand vereinbart. Der Verkäufer ist berechtigt, Klage auch am Sitz des Kunden zu erheben.

16.4. Erfüllungsort für alle Verpflichtungen aus dem Vertragsverhältnis ist der jeweilige Sitz des Verkäufers.

§ 17. Gerichtsstand, Anwendbares Recht, Vertragssprache

17.1. Gerichtstand und Erfüllungsort ist der Sitz des Verkäufers, wenn der Besteller Kaufmann, juristische Person des öffentlichen Rechts oder öffentlich-rechtliches Sondervermögen ist.
17.2. Es gilt das Recht der Republik Österreich. Dies gilt nicht, wenn zwingende Verbraucherschutzvorschriften einer solchen Anwendung entgegenstehen.
17.3. Vertragssprache ist deutsch.

§ 18. Online-Streitbeilegung

Online-Streitbeilegung gemäß Art. 14 Abs. 1 ODR-VO: Die Europäische Kommission stellt eine Plattform zur Online-Streitbeilegung (OS) bereit, die Sie unter http://ec.europa.eu/consumers/odr/ finden.
